Terms & Conditions

In plain English

  • You must be 18+ to use Emmy. Emmy is for parents and caregivers — not children.
  • Emmy is a helper, not a professional. Double-check important things (deadlines, medical, legal, purchases).
  • You own your family data. We only do with it what the Privacy Policy says.
  • Emmy never sends messages, buys anything, or books anything without your approval.

If anything material changes, we'll let you know.

1. Agreement

These Terms & Conditions ("Terms") are a binding agreement between you and Emmy ("Emmy," "we," "us," "our") governing your use of the Emmy website, mobile experience, and services (together, the "Service"). By creating an account, checking the "I agree" box at sign-up, or using the Service, you agree to these Terms and to our Privacy Policy.

2. Who can use Emmy

You must be at least 18 years old and legally able to enter into a contract. Emmy is designed for parents, guardians, and caregivers. Emmy is not intended for use by children. Children do not create accounts. Parents may add information about their children to their private household profile, and are responsible for that information (see Section 6).

3. Your account & household

  • You are responsible for keeping your password confidential and for all activity on your account.
  • The first member of a household becomes its "head of household" and may invite co-parents or caregivers. Everyone in a household can see the household's family profile, children, plans, and shared data.
  • You'll tell us promptly (support@heyemmy.com) if you suspect unauthorized use.

4. What Emmy does (and doesn't) do

Emmy reads family/school/childcare emails and messages you connect or paste in, and turns them into cards, plans, drafts, and reminders. Depending on your Trust Mode setting, Emmy may prepare actions for one-tap approval. Emmy will not send emails, complete purchases, or make bookings on your behalf without your explicit approval.

Emmy is not a substitute for professional advice. It is not a medical, legal, mental-health, financial, or educational professional. Do not rely on Emmy for emergencies. For urgent matters — including a child's safety, health, or well-being — contact appropriate professionals or emergency services.

5. AI content

Emmy uses AI to summarize, draft, and suggest. AI output can be wrong, outdated, or incomplete. You are responsible for reviewing AI output before acting on it (e.g., before sending a drafted reply, adding an event to your calendar, or completing a purchase).

6. Your content & your children

  • You retain ownership of the information you provide, including messages you paste in, notes, preferences, and information about your children ("Your Content").
  • You grant Emmy a limited license to store, process, transmit, and display Your Content solely to operate the Service for you and your household.
  • You represent that you have the right to provide any information about your children that you enter, and that doing so is consistent with the rights of any co-parent or guardian.
  • You will not upload content about anyone else (including children) that you do not have the right to share.

7. Acceptable use

You agree not to:

  • Use Emmy for anything illegal, abusive, harassing, or harmful to a child or another person.
  • Attempt to reverse-engineer, scrape, or interfere with the Service or its security.
  • Use Emmy to make automated decisions with legal or similarly significant effects on someone else.
  • Upload malware, spam, or content that infringes someone else's rights.
  • Use Emmy on behalf of a child, or let a child use your account.

We may suspend or terminate accounts that violate these Terms.

8. Connected services

When you connect a third-party service (e.g., Gmail, Google Calendar, Brightwheel), you authorize Emmy to access that service on your behalf under its terms. Those services are not controlled by Emmy, and their terms and privacy practices apply separately. You can disconnect them at any time from Settings.

9. Text messages (SMS)

Text messages are entirely optional and are never required to create an account, use Emmy, or make a purchase. You opt in by entering your mobile number and separately checking the unchecked consent box shown after creating an account, in Settings → Text updates. The exact wording you agree to, plus a live copy of the opt-in box, is published at beta.heyemmy.com/sms.

  • What we send: messages about your own household only — pickup and drop-off changes, plan and schedule updates, order and delivery updates, and reminders you asked for. We do not send marketing or promotional texts, and we do not text you on behalf of third parties.
  • Message frequency: Message frequency varies. Emmy only sends SMS/text messages in response to activity in your own account — a reminder you set, a plan or pickup change, or an order update — so you receive a message each time one of those is triggered.
  • Rates: Msg & data rates may apply, depending on your mobile phone service plan.
  • Help & Stop: Reply HELP for help or STOP to cancel any time. Replying STOP records an opt-out and stops all further messages; you can also turn text updates off at any time in Settings. For help, reply HELP or email support@heyemmy.com.
  • Consent records: we store your consent, the exact wording you agreed to, and a timestamp, so we can show what you opted into.
  • Your number: mobile information and SMS opt-in data are never shared with or sold to third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.
  • Accurate number: you confirm the number you provide is yours and that you're authorized to receive texts at it. Tell us if it changes or is reassigned.
  • Message delivery depends on your carrier; carriers are not liable for delayed or undelivered messages.

10. Purchases initiated through Emmy

If Emmy helps you shop or reorder items, the actual purchase is between you and the retailer. Prices, availability, and delivery are determined by the retailer. Emmy is not responsible for retailer errors, delivery delays, or product quality.

11. Beta service

Emmy is currently offered in beta. Features may change, break, or disappear. We may add paid plans in the future; we'll tell you before charging you anything.

12. Fees

Emmy is free during beta. If we introduce paid features, we'll present the price and terms before you're charged. You can cancel a paid plan at any time from your account.

13. Intellectual property

The Emmy name, logo, product interface, illustrations, and software are owned by us or our licensors and are protected by intellectual-property laws. Except as expressly permitted, you may not copy, modify, or create derivative works of the Service.

14. Termination

You may delete your account at any time from Settings. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. On termination, Sections that by their nature should survive (e.g., ownership, disclaimers, limitations of liability, dispute resolution) will survive.

15. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate.

16. Limitation of liability

To the maximum extent permitted by law, Emmy and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) US $100.

17. Indemnification

You agree to indemnify and hold Emmy harmless from claims arising out of Your Content, your use of the Service, your violation of these Terms, or your violation of any third-party right (including the rights of a co-parent or child's other guardian).

18. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction. If you are a consumer in the EEA/UK, this does not deprive you of protections under the mandatory law of your country.

19. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you by email or in the app. Continued use after the effective date of an update means you accept the updated Terms.
